3 LC teens facing child porn charges

LAS CRUCES, New Mexico At least three Las Cruces teenagers are suspected of distributing child pornography after using cell phones to allegedly forward inappropriate images of teen girls to friends and a Snapchat site, police said.

Investigators said two of the teenagers, a 13 year old boy and a 13 year old girl, have been charged with felony counts of distributing child pornography. Police said charges against a 15 year old boy, and others who may have possessed or distributed the images, are pending.

Two of the incidents were allegedly initiated by teen girls who took inappropriate photos of themselves and texted the photos to their boyfriends. The boyfriends then shared the images with friends, police said.

New Mexico law does not criminalize consensual sexting, including nude photos, between teenagers in between the ages of 14 to 18.

However, police said the three cases they are investigating involve nude photos shared with others on a Snapchat account, without the consent of the girls.

Police are not identifying the teenagers or the schools they attend. Investigators believe none of the images are believed to have been taken at or during school hours.

Police and the district attorney said the arrests should serve as a reminder to everyone that the manufacturing, possession or distribution of child pornography is a felony offense. For those convicted, the charges could remain on a criminal record for life. Those convicted also could be ordered to register as a sex offender.

The Las Cruces Police Department is encouraging parents in New Mexico to talk with their children and explain the ramifications of taking, sending or receiving sexually explicit images of children.

In Texas, sexting by teenagers is no longer considered a felony offense. On September 1, 2011, then Governor Rick Perry signed a bill into law decreasing the penalty for teenagers who are caught to a misdemeanor.

Prior to the passage of the law, juveniles caught sexting could face felony charges and be forced to register as a sex offender. A sexting offense is now a Class C misdemeanor for first time violators under the age of 18.
